Videotape Evidence
Using the Dashboard Camera for Your Defense
Eric L. Mayer — Experienced Indianapolis DUI Defense Lawyer
Video surveillance is being increasingly used by police to support drunk driving charges and corroborate the arresting officer's observations. However, many times that same camera mounted on the squad car's dashboard can help the accused driver, not the prosecution.

Videotape Evidence - It could be on YOUR side
After you retain the Law Office of Eric L. Mayer to defend you against DUI/DWI/ OWI charges, one of the first things we will do is obtain law enforcement's video tape recording of your traffic stop, roadside sobriety tests, and subsequent arrest. Meant as a tool for police and prosecutors, the dashboard camera can often backfire when:
-
The camera shows that the driver was not weaving or driving erratically, calling into question the officer's observations and probable cause for pulling the driver over.
-
The tape contradicts conclusions drawn by the officer from field sobriety tests For example, the camera shows the suspect standing on one leg for 30 seconds without problem or performing the "Walk and Turn" without swaying or staggering.
-
The arresting officer deliberately turns off the camera, perhaps in violation of department policy, thereby creating reasonable doubt that the driver had showed signs of intoxication.
-
The videotape "disappears" and the prosecution is unable to produce it for trial. This may lead to a dismissal or give the jury a reason to acquit.
Prosecutors commonly use videotape evidence to show what an intoxicated driver did wrong leading up to the arrest. We may be able to use it to your advantage by showing what you did right.
